ATTORNEY CONVINCES JUDGE TO GIVE PROBATION ON CLIENT’S SECOND FELONY DWI
Congratulations to our Attorney Kassius Benson and our client “S.A.” who obtained a rare sentencing departure to probation for his second felony DWI following a contested hearing in Anoka County, Minnesota. Despite the fact that our client was on felony DWI probation when he committed this new offense of felony refusal to submit to testing, the attorneys convinced the Court that a probation sentence was appropriate rather than a prison sentence. The favorable sentence was the result of an individualized, comprehensive sentencing strategy devised by the Firm over a year ago when we accepted S.A.’s difficult case, our client’s dedicated completion of an intensive dual-diagnosis treatment program and the support of client’s family. Senior Counsel Kassius Benson stated that “this case was exceptionally difficult due to client’s prior record and apparently untreatable alcohol use. However, we spoke to him in great detail prior to taking his case and knew we could devise a strategy for obtaining the probation result we wanted. our client bought into our plan, dedicated himself to the program, and the judge fortunately saw the situation the way that we did.”
